DeKALB – A DeKalb man is charged with hate crime after police say he called another man a racial slur which starts with ‘n,’ headbutted him and threatened to kill him.
Duane J. Garcia, 43, of the 400 block of College Avenue in DeKalb, is charged with a hate crime, battery and assault for the incident which police say took place June 27, according to DeKalb County court records.
If convicted of the most serious crime of a hate crime, Garcia could face up to 6 years in jail.
According to court records, police say Garcia “aggressively approached” a man in the 400 block of College Avenue around 2:30 p.m. June 27 and call him a racial slur that begins with the letter n, and accused the man of having sexual relations with his wife, which reports show the man denied.
As the argument progressed, Garcia then headbutted the man, stood over him and threatened to kill him or have a Latin Kings gang member killed him, records show.
When DeKalb police arrived on the scene, Garcia refused to talk with them, instead yelling from outside his bedroom window repeated racial slurs and refusing to come outside.
